**IMPORTANT**


Before any lead dust samples can be taken a visual inspection of the property must take place. There can be no peeling or chipping paint any where on the inside as well as the outside of the property. (This includes the entire interior of the property as well as exterior fascia,soffit,window trim, painted porches and foundations,exterior wooden doors and jambs ect)


If your rental property has replacement windows the state of Maryland requires that 1 lead dust sample be taken from the floor or window sill of every room. If there are any rooms that have original painted wooden windows the state of Maryland requires that 2 lead dust samples be taken from every room ( 1 from the floor or window sill and 1 from a window well from a random window in that room) * the window well is the area where the sash comes down and meets the bottom of the window frame*
TheSamples are collected and shipped overnight to lab where the lead dust content of each sample is measured. The results are sent via email to Edwards and Son and the client is notified by phone and email that the property has passed.Your MDE certificate is issued and in the mail within 24 hours.

Participation is mandatory for rental units that were built before 1950. Compliance makes the owner eligible for limited liability for that unit. Units that were built after 1950 who opt in to the program may enjoy limited liability, but all requirements must be met.
Properties built before 1950
Properties built between 1950 and 1978
must be reinspected
-at unit turnover
-upon complaint of tenant
-when notified of elevated blood level in children or pregnant women
may opt in to pre 1950 group to enjoy limited liability benefits 
must distribute lead info packet to tenant
may obtain a lead-free certificate and either opt in or opt out 
In case of lead poisoning landlords maximum liability is $17,000 If you choose to opt out your maximum liability could be in the millions

A Risk Reduction Certificate can be issued to all rental properties that pass a visual inspection and a lead dust test.

OR 

Perform all of the following Lead Hazard Reduction Treatments 



 LEAD HAZARD REDUCTION TREATMENTS
Remove any chipping ,peeling or flaking paint and repaint. (interior and exterior)
Repair structural defects that cause paint to chip, peel and flake
Strip, replace, or encapsulate interior sills
Cap window wells in order to make them smooth and cleanable
Fix top sash of all windows to prevent friction caused by the opening and closing of windows
Rehang all doors to prevent rubbing
Ensure that kitchen and bathrooms have smooth, water-resistant floors
Make all bare floors smooth and cleanable
HEPA vacuum and phosphate wash the interior of the unit
Supervisors statement of work ( signed statement from an accredited supervisor stating all treatments were performed in accordance with COMAR 26.16.02.03 and applicable regulations
